Article 2. Client and registration on the site

By placing an order, in any way whatsoever, the Customer declares to be of legal age and to benefit from the legal capacity necessary to contract. 

 

 

Article 3. Products

Pursuant to Article L.111-1 of the Consumer Code, AML-PARIS makes available to you, prior to the conclusion of the sales contract, the products offered for sale as well as their essential characteristics. 

 

The products offered for pre-order by AML-PARIS are only offered within the limit of the pre-order period as announced and are only available on condition that the announced minimum number of pre-ordered products is reached (hereinafter "Pre-order" ). 

Each pre-order campaign is the subject of information, permanently available on the Site, relating to the duration of this campaign and the minimum number of parts required to launch the pre-order from our suppliers. 

 

Products remaining in stock after delivery and possible return of pre-ordered products are only offered within the limits of available stocks (hereinafter "Ordering products in stock"). 

 

In accordance with European legislation, the fiber composition of the clothing offered for sale by AML-PARIS is available for each product and displayed on the Site.

Article 4. Pre-order and order

          Article 4.1. Pre-order 

Placing a pre-order is subject to compliance with the procedure put in place by AML-PARIS, which includes successive stages leading to its validation (selection of items, viewing of your basket, choice and delivery terms, validation and confirmation of your order, payment).

Before proceeding with this validation, you must read and fully accept these GTC by checking the box "I have read and accept the General Conditions of Sale of AML-PARIS and I undertake to pay my order" . 

 

In accordance with article L.221-13 of the Consumer Code, you will then receive electronically, which you accept, a summary confirmation of your pre-order. 

Invoices are available on your customer account and are, in any case, handed over upon delivery. 

 

If the minimum objective of the pre-order campaign is not reached when it is closed, AML-PARIS will cancel your pre-order and refund the full amount, including costs, within a maximum period of 14 working days. 

 

          Article 4.2. Ordering products in stock

Article 5. Price and terms of payment

The prices indicated on the site www.AML-Paris.com are expressed in euros, VAT included (TTC). 

 

VAT is applied at the rate in force in mainland France at the time of the order. 

Prices are exclusive of delivery costs, which are added during the pre-order or order process. 

For deliveries outside the European Union and in the French overseas departments and territories, the order will be made tax free. In the event that customs duties, import taxes or applicable local taxes are payable, these costs are the responsibility of the Customer and are their sole responsibility. 

 

AML-PARIS reserves the right to change the price of a product from one pre-order period to another without this modification having an impact on a pre-order or an order already placed. 

Payment for purchases is made either via PayPaL or via the secure platforms of our payment provider STRIPE. 

 

The products are payable on order, in cash (Bank cards, PayPaL) according to the online payment system chosen by the Customer.   

AML-PARIS reserves the right to suspend or cancel any order or pre-order in the event that your authorization to pay by credit card is refused or in the event of non-payment. 

 

AML-PARIS also reserves the right to refuse or cancel an order or pre-order from a Customer with whom a payment dispute is in progress or has taken place on the occasion of a previous order or pre-order or in cases of objective suspicion of fraud.

Article 6. Delivery

 

          Article 6.1. Terms of delivery

 

Deliveries are made by COLISSIMO or DHL. 

 

They are made to the delivery address indicated by the Customer, which must correspond to his address of residence, to the address of any other natural person of his choice or to his business address. 

Delivery cannot be made to hotels or PO boxes. 

 

The Customer must ensure that they provide AML-PARIS with accurate and complete information relating to the delivery address. 

In the event of an error in the wording of the contact details of the recipient of the package, AML-PARIS cannot be held responsible for the impossibility of making this delivery. 

 In the event of absence or impossibility of delivery of the parcel, COLISSIMO will leave you a transit advice note mentioning the address of the post office where you can collect it on presentation of an identity document, and the date on which it will be available there. 

In the event that the parcel cannot be delivered or cannot be delivered, DHL will leave you a calling card to schedule a new delivery.

 

          Article 6.2. Delivery delay

AML-PARIS markets ready-to-wear pieces by direct order (pieces in stock) or by pre-order in order to meet a need for responsible production and consumption at a lower cost. The manufacture of these parts is only launched after the pre-order period with our suppliers has ended and provided that the minimum manufacturing quantities have been reached. 

The times between your pre-order and delivery vary depending on the type of product offered and its manufacturing requirements. You will be regularly informed of the manufacturing steps and the progress of your order. 

As soon as the pre-order period ends and after verification with our suppliers and manufacturers of the manufacturing times, you will be informed of the firm delivery time of your AML-PARIS part. In any event, the maximum delivery time for pre-order products will be 6 months from the end of the pre-order campaign. 

 

In the event of an order for products in stock, they will be delivered within three weeks of placing the order on our Site. 

 

 

          Article 6.3. Receipt of products and transfer of risk 

Pursuant to Articles L.216-3 et seq. Of the French Consumer Code, any risk of loss or damage to goods is transferred to the Customer when the latter, or a third party designated by him, and other than the proposed carrier. by the AML-PARIS, takes physical possession of these goods. 

Delivery is deemed to have been made upon delivery of the product to the Customer by the carrier, materialized by the control system used by the latter. Article 7. Right of withdrawal

AML-PARIS will send you an electronic confirmation without delay.

You must return your product no later than 14 days following the sending of your withdrawal using the return slip provided by AML-PARIS at the address:

The return is the responsibility of the Customer outside mainland France (only the direct cost of shipping). If you paid with PayPal, you can have these return costs refunded on the PayPal interface in accordance with PayPal's terms of use.

 

The product must be returned in its original packaging, in its original condition, new, unworn, unwashed. 

 

AML-PARIS will reimburse you for the full amount of your order, including the initial delivery costs, on the day on which the order to which your withdrawal relates has been received by us, using the same means of payment to make this reimbursement as the one used for the payment of the order. 

 

At the end of the withdrawal period, the sale is firm and final. 

 

 

 

 

 

Article 8. Returns, exchange and refund 

 

You have 14 days after receipt of your order to return your parts to us for a refund or to make an exchange.

AML-PARIS will acknowledge receipt to you without delay. You will then have another 14 days to reship your part using the return slip provided by AML-PARIS to the address:

Return is free from mainland France. 

The return at the expense of the Customer outside mainland France (only the direct cost of shipping) except in the case of a product that does not comply with your order, in which case the support will be at our expense. If you paid with PayPal, you can have these return costs refunded on the PayPal interface in accordance with PayPal's terms of use.

 

The product must be returned in its original packaging or other suitable packaging, in its original condition, new, unworn, unwashed, for an exchange or refund. 

 

Exchange will be possible while stocks last. 

Otherwise, we will reimburse your entire order. 

 

The refund will be made within 7 days of receipt of your product return. 

The exchanged product will be sent to you within 10 days.

 

  

Article 9. Legal guarantees and limitations of liability

 

All products for sale on the www.AML-Paris.com site benefit from the legal guarantee of conformity provided for and defined by articles L.217-4 and following of the Consumer Code and the guarantee against hidden defects provided for and defined in articles 1641 and following of the Civil Code. 

          Article 9.1. Legal guarantee of conformity 

 

Under Article L.217-4 of the Consumer Code: 

 

“The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, assembly instructions or installation when this has been charged to it by the contract or has been carried out under its responsibility ". 

 

Under the terms of article L.217-5 of the same code, "the good complies with the contract:

- if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model

2 ° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted ”As part of the guarantee legal compliance, the Customer is informed that in application of articles L.217-7 and following of the same Code: 


- Action resulting from lack of conformity lapses two years after delivery of the goods;


- Defects of conformity which appear within 24 months from issue are presumed to exist at the time of issue, unless proven otherwise. This presumption can be disputed by the seller if it is not compatible with the nature of the good or the lack of conformity invoked;

 

- In the event of a lack of conformity, he may choose between repair and replacement of the good subject to the cost conditions provided for in article L.217-9 of the Consumer Code and the conditions provided for in article L. 217-10 of the same code;

          Article 9.2. Guarantee against hidden defects 

 

Under article 1641 of the Civil Code: 

 

"The seller is bound by the warranty for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have given a lower price, if he had known them ”. 

 

As part of the guarantee against hidden defects, the Customer is informed that in application of articles 1642 and following of the same code:

 

- The action resulting from hidden defects is prescribed by two years from the discovery of the defect; 

- AML-PARIS is not liable for apparent defects which the buyer has been able to convince himself;

- AML-PARIS is held liable for hidden defects of which it could legitimately have knowledge at the time of the sale; 

- After assessment of the defect, the Customer has the choice of returning the item and having the price returned, or keeping the item and having part of the price returned. 

Products modified, repaired, integrated or added by the Customer or due to improper use for their intended purpose by the Customer are excluded from the guarantee against hidden defects.

         Article 9.4. Limitations 

 

It is recalled that in application of article L.221-15 of the Consumer Code, AML-PARIS may be exempt from all or part of its liability by providing proof that the non-performance or improper performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure. 

 

 

 

Article 10. Miscellaneous provisions

 

These T & Cs will come into force on June 28, 2020. 

In the event that one or more provisions of these T & Cs were deemed unwritten or declared void, they will remain applicable in all their other provisions provided that the general economy of the contract is not upset. 

 

 

 

Article 11. Settlement of disputes and applicable law  

 

These GTC are governed by French law.
Any dispute relating to these T & Cs will be submitted to the materially and territorially competent French jurisdiction. 

 

Pursuant to Articles L.612-1 et seq. Of the Consumer Code, provided you have previously sent a written complaint to AML-PARIS, you have the right to have recourse free of charge to a consumer mediator with a view to resolving amicable of a dispute between you and AML-PARIS. Article 12. Force majeure

 

 

AML-PARIS cannot be held responsible for any delay or failure in the performance of our obligations under these General Conditions, if this delay or failure is attributable to a cause beyond our control. Strikes, boycotts, closures of partner companies, commercial disputes, war, whether declared or not, natural disasters, blocking of private or public transport networks, blocking of telecommunications, epidemics, governmental or legal restrictions, are considered to be cases of force majeure. legal or regulatory changes in the forms of marketing and any other case beyond the control of the parties preventing the normal performance of the contractual relationship. Article 13 - Commercial offers and newsletters

 

 

AML Paris has the authorization to send commercial offers by email, SMS or via spaces animated on the web by AML Paris to Customers, subject to prior acceptance. The Customer has the option at any time to object free of charge to these sending of commercial offers by clicking on "unsubscribe" in each newsletter.

 

Article 14 - Reimbursed alterations offer

We do not all have the same morphology, the same length of legs etc: we offer you the retouching so that the part fits you perfectly. We suggest that you send a tailor directly to your home for alterations if necessary. Our partner Tilli is the first home tailoring service carefully selected to pamper you and offer you the best.

A few things to know, however, before ordering a touch-up:

- a retouched part can no longer be returned or refunded: it will fit you like a glove but it will not fit someone else!

- If you are not satisfied with the retouching, AML Paris cannot be held responsible.

- There is a reimbursement ceiling corresponding to the cost of a simple hem, i.e. 12 Euros,

- In order to send you the reimbursement of the alteration costs, you must send us by email at hello@aml-paris.com the following documents: a confirmation of the AML order, a photo of you wearing the AML part before the alteration, and a photo of you wearing the part after the retouching, the TILLI invoice corresponding to the retouching (ask them to mention: AML retouch)
